Everytime I start it, it usually has a busy signal and I can't back out. A few minutes later it will say error, server is busy, try again or return to the Wii menu. Can I fix this or is it a Nintendo problem, ie too many people on at once?

Yes. But after the last system update it seems a little better. The Wii just came out, so there are probably some bugs to work out, just like the DS Wi-fi had issues when it first came out too.
